O Brasil aplica a “justiçaria” e repete os erros da Europa.   Por Marcos Alencar Não precisa ir à Espanha, França, Itália e Portugal para sabermos os erros praticados quanto à questão trabalhista frente à crise que vem sendo enfrentada. Se lermos os jornais e outras publicações da época (de 2009 em diante) verão os empregadores sucumbindo e ao mesmo tempo tendo que manter o pagamento dos salários e demais direitos. Nestes países há uma independência entre direitos trabalhistas versus situação empresarial, o segundo quando conquistado sobrevive eternamente. Com a quebra dos americanos em 2008, as empresas europeias começaram a perder fôlego financeiro e econômico e ao mesmo tempo tiveram que manter o gasto com a folha de pagamento. O dinheiro parou de entrar no caixa da empresa e a despesa continuou sendo a mesma. Com isso, as empresas foram consumidas rapidamente, perderam força e muitas morreram. Com a morte da empresa, se mata também os contratos de trabalho. Eu não sou contra o sistema normativo trabalhista que vem sendo regido desde a era Vargas baseada na Consolidação das Leis do Trabalho, entendo que a CLT não está atual, mas não é a mesma a grande vilã do caminho errado que o trabalhismo brasileiro segue. Para mim, o grande mal que aflige as relações de emprego, é o pensamento dos que julgam (a começar pelo Tribunal Superior do Trabalho) e a conduta ativista que vem se arraigando na Justiça do Trabalho em todas as suas instâncias. A mentalidade da maioria dos julgadores trabalhistas se calca nos graves equívocos dos espanhóis e vizinhos de continente, ao entender que pouco importa a situação do empregador e que independente disso deve ser mantido o pagamento de todos os direitos, o que é pior, os empregos. Exemplo: O empregador notoriamente falindo e sendo obrigado a manter empregados todos os seus funcionários, sob pena do pagamento de multa diária e de liminar impedindo a demissão coletiva. (Caso Eike). O ativismo judiciário (que defino como “justiçaria” – mix de justiceiro com feitiçaria) é o câncer que se instala no sistema trabalhista brasileiro. O Magistrado julga usando da Lei apenas como uma referência, jamais como um limite. O “achar o Juiz” passa a ser o fundamento legal. Legal quer dizer legalidade, lei, aquilo que foi votado e que deve o Juiz aplicar ao apreciar os casos e julgá-los. Outro ponto que merece ser visto é quanto à legitimidade para julgar com base em “achismo”, porque a “lei” foi votada no Congresso Nacional e o ato de “achar” parte da restrita mentalidade do Judiciário. Não estou aqui falando mal da magistratura e nem dos que julgam, mas chamando à atenção de todos para um problema que vem ganhando corpo e se instalando no Brasil, pois na medida em que a sociedade aceita julgamento e determinações sem base na lei, somente porque favorecem a classe trabalhadora, passamos a viver num regime de exceção, sem regras legais e sem segurança jurídica. A partir do momento que vejo um Tribunal determinando pagamento de multa por demissões coletivas que são permitidas por lei, tratando isso no campo das ilegalidades, eu sinceramente fico deveras preocupado. Estamos literalmente vivendo numa terra de muro baixo, que a própria Justiça descumpre a lei e nada acontece. Como sabemos, numa sociedade organizada e democrática, acima do Judiciário só existe Deus. Se a justiça corrompe a legalidade e passa a decidir pelo que acha, estamos perdidos. O mais interessante é receber críticas de que estou aqui defendendo a classe empresarial, quando tenho plena consciência que estou defendendo o emprego e os trabalhadores. Tenho a oportunidade de possuir amigos empregados na Espanha, na Inglaterra e nos Estados Unidos, sei a realidade de cada um e como está sendo a reação dos empregados à crise. Como não tenho aspirações políticas, fica aqui a minha indignação. ///////

No need to go to Spain, France, Italy and Portugal to know the errors committed on the labor issue facing the crisis that is being faced. If we read the newspapers and other publications of the era (2009 onwards) summer employers succumbing while having to keep paying wages and other rights. In these countries there is independence between labor rights versus business situation, the second when conquered survives forever.

I’m not against the labor regulatory system that has been governed since Vargas was based on Consolidation of Labor Laws, I understand that CLT is not present, but it is not the same as the great villain of the wrong path that follows the Brazilian Labour. For me, the great evil that afflicts employment relations, is the thought of judging (starting with the Superior Labor Court) and conduct activist who has become embedded in the labor courts in all instances.
The mentality of most judges labor is pants in serious misunderstandings of the Spanish mainland and neighbors, to understand that it does not matter the situation of the employer and whether it should be kept the payment of all duties, what is worse, the jobs. Example: An employer notoriously failing and being bound to keep employees all employees, under penalty of a fine day and an injunction preventing mass layoffs. (If Eike).
The judicial activism (which I define as “justiçaria” – mix vigilante with witchcraft) is cancer that develops in the Brazilian labor system. Magistrate judges using the law as a reference only, never as a limit. The “find the Judge” becomes the legal basis. Legal means legality, law, what was voted on and that the judge should apply when assessing cases and try them. Another point that deserves to be seen is as to the legitimacy to judge based on “guessing”, because the “law” was passed in Congress and the act of “finding” part of the narrow mindset of the judiciary.
I am not here speaking ill of the judiciary nor the judging, but calling the world’s attention to a problem that is arising and settling in Brazil, because in that society accepts without judgment and decisions based on the law, just because favor the working class, we now live in a dictatorial regime without rules and without lawful legal.
From the moment I see a court determining the payment of fines by layoffs that are permitted by law, treating it in the field of illegalities, I honestly am greatly concerned. We are literally living in a land of low wall that Justice itself violates the law and nothing happens. As we know, in a democratic polity and above the judiciary exists only God. If justice corrupts the legality and shall decide by what you think, we are lost.
The most interesting is receiving criticism that I’m here defending the business class, when I am fully aware that I’m defending jobs and workers. Have the opportunity to have friends employed in Spain, England and the United States, know the reality of each one and how is the reaction of employees to the crisis. Since I have no political aspirations, here is mine indignation.
